Are you for or against same-sex marriage in Taiwan?

May Taiwan be first in Asia to legalize same-sex marriage (https://en.wikipedia.org/wiki/LGBT_rights_in_Asia)?
Do you doubt about it or are you confident of this soon in action? 

Yes, Taiwan is the first country in Asia to grant couples of same sex the right to marry according to the supreme court's interpretation of the Constitution on May 24, 2017 (This is revised on May 24 and please read the last paragraph added to this article).

Matter-of-factly the Civil Law adopted defines marriage as an official relationship of a man and a woman who meet the requirements of the procedure of marriage. Article 980 stipulates that a man beyond 18 years old or a woman reaching the age 16 is allowed to choose his/her spouse of his/her free will. Monogamy is the principle for a married couple to follow.

It is beyond doubt that the sexual intercourse is one of important interactions in a marriage (a man and a woman, of course). The marriage could be terminated if one party cannot fulfill this duty in three years according to Article 995. It seems that so-called responsibility to you might be a desperate sexual desire of your spouse in a marriage.

It’s concluded that in Taiwan married heterosexual couples are expected to stay in a relationship not only of loving but making love well. That tells mental and physical intimacy with each other is a must.

Same-sex marriage

On June 26th in 2015 a divided Supreme Court in America ruled that states cannot ban same-sex marriage. That means that last year America became the 21st country to legalize same-sex marriage. That promised married couples of same sex will enjoy both of the same legal rights and benefits as married heterosexual couples, which is recognized on official documents of birth or death certificates.etc. As a democratic country, America did take a very long time for all states to reach this – no more discrimination between different sexual orientations.

 In Taiwan, Article 7 of the 1947 in the Constitution states all citizens of the Republic of China/Taiwan, irrespective of sex, religion, race, class or party affiliation, shall be equal before the law. What if one chooses a spouse of the same sex since the Constitution promises to give equality to its citizens before the law? Or is it against the Civil Law of marriage?  

The issue of same-sex marriage has been brought up and argued for a long period of time by both parties, for and against it. An agreement on same-sex marriage hasn’t been made. People do give much pressure on shoulders of those legislators who might consider whether or not which is more important to accept and respect it or to hold the cornerstone traditional family values heavily rest on. Now, there might not be a guarantee that the Legislative Council will revise the civil law to legalize same-sex marriage.

The data collected by the Foundation of Taiwan Public Opinion (å°ē£ę°‘ę„åŸŗé‡‘ęœƒ) shows that 46.3% of people agree to revise the Civil Law for same-sex marriage while 45.4 of people hold the opposite views on this move of this amendment (United Daily News, November 29, 2016).

In retrospect, it seemed clichƩ for those countries which have gone through all those arguments and irrational moments about same-sex marriage and finally found a way to accept and respect what they had thought should have been intolerable. But, the deep divisions caused by opposite and hostile thoughts towards same-sex marriage are still under dispute in Taiwan.


Definition of a family

How do you define a family? Do you agree that a normal family is a marriage couple, a man and a woman, and their own children, biological or adopted ones, living together before or even after the children grow up? Are you afraid a new trend toward accepting an emergence of same-sex marriage in our society? Why?

Have you questioned whether or not it is true that the union of a man and a woman in an official relationship, a marriage, is the only way to follow natural law? Are you convinced that a family holds our society tightly together and our children can grow up feeling euphoric in a place, where they learn their gender roles? If “Yes,” are we risking destroying the fundamentals of a family, a society and our country? If same-sex marriage is legalized, there won’t be traditional values of a family left behind you give it a serious consideration too, don’t you?

Legalization of same-sex marriage might have strong impacts on people’s beliefs and views of their religions. That would offend what they believe and therefore the morals could lose footholds too. How could they let this happen without speaking loud out their anger and opposition to this?

Why is there a need to change if marriage is a sound system to allow a man and a woman in love to live together and seal their relationship under the protection of the law after the Constitution was adopted in 1947 in Taiwan?

Critics argue that gay people are not stopped from loving each other and they could stay in a relationship as long as they like. Then, the critics don’t understand why gay people want to marry. It is because gay people love each other and they want to make a commitment to each other through a legal marriage in the same way as straight couples. 

There were more than 20,000 protesters marched through Taipei presenting their propaganda in front of the Legislative Council and showing the signs “stand forward for the next generation’s happiness.”

People who are against same-sex marriage do believe that marriage of man and woman promises to give their children an environment where their gender role models are offered. Boys learn how to become a “man” and girls a “woman.” Yes, ideally it should be the way if the father is a good model and so is the mother. So, they worry about the couple of same-sex marriage might adopt children or they might have their own biological children for two women in a marriage. It might be a very contagious for their children to become gay people too.

But, what about a single-parent family? Do you think a single parent with efforts is never able to teach his/her children very well to the utmost? Is there a need to find his/her new spouse just for a gender role model? It is not necessary, is it? If you agree with it, you might give it a thorough thought about the coming question.


Is it right to blame the couple of same-sex marriage not offering their children gender models? Why can’t the children of a same-sex married couple in good and stable relationship grow up the way like others of heterosexual married couples? To be honest, talking about bringing up your children well, your relationship with your spouse should be amicable at least. Obviously, it seems irrelevant to if the marriage is of same-sex marriage or heterosexual marriage.

Discrimination based on sexual orientation is banned at work and schools. Besides, changing one's gender is legal if it is assessed and then permitted. If this is an announcement of equality and freedom to be yourself, why same-sex marriage can’t be legalized?

Public support for legalizing same-sex unions is robust, and there was a parade in Taipei, which attracted about 80,000 participants from Taiwan and around Asia (Chris Horton, New Pacific, November 18, 2016).

Shouldn’t we be more open and flexible to all possibilities when some people show how much they want to be officially with the ones who love dearly when some are obsessed with the topic of the social norms for a married couple, others might insist on flouting them? I do believe that no matter what differences do exist among people, we have to remain calm and keep ourselves from being irritated by a clique of groups delivering dissatisfied speeches. A harmony environment is what we hope to live in, isn’t it?

The ruling party, Democratic Progressive Party (DPP), drafted the historic bills of same-sex marriage in October. What comes after this you might wonder?

The supreme court in Taiwan has cleared off the doubt if a same-sex marriage violates the Constitution on May 24, 2017. The announcement of the supreme court delivers legality of same-sex marriage to gay people in Taiwan. Not from now on a couple of the same sex are allowed to marry but after the Legislative Yuan amends or enacts the new laws in two years, including the right of women, barren of children, to look for a surrogate mother. Please be patient...
